By bidding, you agree to these terms and you accept and take responsibility that all items purchased through ONEUPBIDDER.COM become the sole property of the buyer upon close of the auction & successful payment. ONEUPBIDDER.COM assumes no responsibility for delivery of items to any location if you fail to pick your items up on the scheduled pick up dates. No refunds will be issued by ONEUPBIDDER.COM if you fail to retrieve your items and they will be considered abandoned at the end of the LAST posted scheduled pickup date/time. Items will not be held for more than 14 days unless you have made prior arrangements. A $25.00 handling fee will be assessed for orders held longer than 14 days. ONEUPBIDDER.COM DOES NOT SHIP. At pickup time and location, you must provide packing material, boxes, and manpower to load your purchases. We do not load or offer assistance in loading your purchases. **ATTENTION ALL BUYERS-PLEASE READ IN REGARDS TO PAYMENT FOR YOUR PURCHASES** Upon successful registration and clicking the Agree to Term & Conditions box below, the buyer agrees and grants permission to Chuck & Hoppy’s Marketplace, LLC to bill the buyer’s credit card used for this registration for all items the buyer purchases in this auction. The buyer also understands by agreeing to these terms that they will be billed for these purchases regardless if the buyer fails to take ownership of the items at one of the scheduled pickup days. Buyers that fail to take ownership of their items, and refuse to pay for these items, will be blocked from all future online auctions conducted by ONEUPBIDDER.COM, and legal action will be brought against these buyers to secure payment on the items purchased, at the buyers expense. PAYMENT. WE NO LONGER ACCEPT CASH PAYMENTS! We accept MasterCard, Visa, Discover. WE DO NOT ACCEPT AMERICAN EXPRESS. BUYERS’S PREMIUM. A 13% BP will be added to the final invoice for all bidders for this auction. CONDITION OF ONLINE AUCTION ITEMS IS “AS IS WHERE IS.” The buyer/bidder is responsible for inspection of items for defects on preview days. All items are sold AS IS WHERE IS, no warranty or guarantee of any kind. All sales are FINAL! All descriptions are believed to be accurate, however, all bidding and buying is based soley on bidder's personal inspection and/or opinion of the items. BUYER INSPECTION. It is the BUYERS responsibility to perform all inspections of the items and to be satisfied as to an item’s description, condition and/or authenticity prior to bidding. Each buyer/bidder should independently verify any information they deem important including information available. Verify all information contained in the item description and all promotional materials, including, but not limited to, photographs, dimensions, conditions, etc. These were provided by or on behalf of the seller and are believed to be correct; however, neither the seller or the auction company makes any promise, representation, guarantee, or warranty as to the accuracy or completeness of such information, inspect all items prior to bidding. Failure to inspect the property does not relieve the bidder of responsibility for payment and removal as stated in these terms. SELLER DISCLOSURE. In an effort to maintain integrity and transparency, ONEUPBIDDER.COM strongly discourages sellers from purchasing their consigned items personally or through a 3rd party through the online auction. ONEUPBIDDER.COM will permit seller PO (Pullout) at the seller’s discretion. The State of Texas does allow Buyers to purchase their items back from auctions so long as the auction company discloses this fact to its buyers. Though strongly discourage, ONEUPBIDDER.COM discloses to all buyers and sellers that all sellers are allowed to purchase their own items through the online auction platform at their own discretion. Sellers that wish to do so will be charged for purchases, with full commissions applied, plus a 5% PO (Pullout). There are no exceptions. CLOSING DAY SOFTWARE SETTINGS. On closing day, please make sure you set the auction to auto refresh every 30 seconds to ensure you are always looking at current information. These settings will appear at the top of the auction catalog when the auction starts to close on the last day. This auction will have a Soft closing which gives all current high bidders that are outbid within the last 2 minutes of the auction an additional 2 minutes to place their final bids. Our auction software can also place your bids by proxy if you are not able to watch the auction close. This means that you can leave your maximum bid and the software will automatically bid for you if you are outbid as the auction progresses. After the auction has completely ended, all winning bidders will be billed and emailed auction results within 24 hours of auction close. You will NOT be contacted if you are not the winning bidder. Our software program will automatically bill auction items to the credit card on file within 24 hours after auction close. If your card declines, you will be notified, and if you fail to remit payment your items will be sold at the next online auction to cover your charges, and any shortfalls will be pursued in Williamson County, Texas Court of Law. BID RETRACTIONS. A bid is a binding contract to buy. Please make sure you have reviewed your bid prior to submitting your bid. Once a bid has been submitted, it cannot be retracted or changed.
